Can an NRI purchase property in India without visiting?+
Yes, with a valid Power of Attorney, an NRI can authorise a trusted person in India to execute property transactions on their behalf. The POA must be notarised by a notary in the country of residence and attested by the Indian Consulate/High Commission. We draft legally sound POAs and co-ordinate transactions remotely.
How can an NRI repatriate sale proceeds from Indian property?+
NRIs can repatriate up to USD 1 million per financial year from the sale of residential property (up to 2 properties) held for the required period, subject to FEMA conditions. Proceeds must first be credited to an NRO account, and repatriation requires a CA certificate and bank application.
What happens to NRI property if the owner dies without a Will?+
Succession to immovable property in India is governed by Indian succession law applicable to the deceased's religion. Without a Will, legal heirs inherit according to statutory succession rules — often requiring a succession certificate or letters of administration from an Indian court, which can be time-consuming. A well-drafted Will significantly simplifies the process.
Can an NRI be a director of an Indian company?+
Yes. NRIs and foreign nationals can be directors of Indian companies. At least one director must be ordinarily resident in India. A DIN is required and KYC documents must be in order. NRI directors may also receive remuneration subject to FEMA and RBI guidelines.
My Indian property is being occupied illegally — what can I do from abroad?+
NRIs facing illegal occupation can take legal action through an authorized representative (POA holder). Options include filing a civil suit for declaration and possession, seeking a temporary injunction, or pursuing criminal complaints. We coordinate legal action on behalf of NRI clients remotely.
