What is the difference between mediation and conciliation?+
In mediation, a neutral mediator facilitates discussion and helps parties reach a mutually acceptable solution — the mediator does not impose a decision. In conciliation, the conciliator plays a more active role, may suggest settlement terms and can make proposals. Under the Arbitration and Conciliation Act 1996, any settlement agreement has the same legal effect as an arbitral award.
Is a mediated settlement legally binding?+
Under the Mediation Act 2023, a mediation settlement agreement is legally binding and enforceable. It can be registered and challenged only on limited grounds (fraud, corruption, impersonation). A settlement reached in court-referred mediation can be made a decree of the court. This gives mediated settlements significant legal force.
Can mediation be used even after litigation has started?+
Yes. The Mediation Act 2023 and CPC allow parties to opt for mediation at any stage of court proceedings. Many courts actively encourage mediation during the pendency of suits. If mediation succeeds, the settlement can be presented to the court and made a consent decree.
Is mediation confidential?+
Yes. Confidentiality is a fundamental principle of mediation. Under the Mediation Act 2023, all communications, statements and documents shared during mediation are confidential and cannot be disclosed in any subsequent proceedings. This creates a safe environment for frank discussion.
What types of disputes are suitable for mediation?+
Mediation works best where parties have an ongoing relationship they wish to preserve; privacy and confidentiality are important; a creative settlement is preferable to a binary court outcome; or the dispute involves a mix of legal and non-legal issues. Particularly effective for commercial disputes, family matters and workplace conflicts.
