How long does trademark registration take in India?+
After filing, the Registry examines the application and typically issues an examination report within 1–3 months. If accepted and published in the Trademark Journal, there is a 4-month opposition window. If no opposition is filed, registration is granted — typically 18–24 months from filing. We manage the entire prosecution process on your behalf.
Can I use the ™ symbol before registration is complete?+
Yes. The ™ symbol can be used immediately upon filing — it signals an unregistered but claimed mark. The ® symbol can only be used after formal registration. Using ® on an unregistered mark is an offence under the Trade Marks Act 1999.
Is software patentable in India?+
Pure software (computer programs per se) is not patentable under Indian patent law. However, software with a technical character — where it produces a technical effect beyond normal computer operations — may be patentable as a computer-implemented invention. We advise on the best IP protection strategy for software products.
What is the difference between copyright and trademark?+
Copyright protects original creative works automatically upon creation — no registration is strictly required. Trademark protects brand identifiers used in commerce and must be registered for statutory protection. A logo can simultaneously attract copyright (as an artistic work) and trademark protection (as a brand identifier).
How do I protect a trade secret in India?+
Trade secrets can be protected through: confidentiality/NDA agreements, contractual non-compete clauses (within reasonable limits), physical and digital security measures, and civil remedies for breach of confidence. We help structure robust trade secret protection programmes.
