What is the fastest way to get a divorce in India?+
A mutual consent divorce under Section 13-B of the Hindu Marriage Act is the fastest route — both parties agree and there is a mandatory 6-month cooling-off period (which courts can waive if parties have lived separately for 18+ months). Contested divorce takes significantly longer, often 3–5 years.
How is child custody determined in India?+
Courts determine custody based on the best interests and welfare of the child — not the rights of parents. Factors include the child's age, emotional bonding, financial stability of each parent, the child's own wishes (for older children) and each parent's ability to provide for overall development.
What maintenance can a wife claim during divorce proceedings?+
Under Section 24 of the Hindu Marriage Act, either spouse can claim interim maintenance during divorce proceedings. Under Section 25, permanent alimony can be claimed post-divorce. Under Section 125 CrPC, a wife (including divorced wife who has not remarried) can claim maintenance.
My spouse obtained a divorce in a foreign country — is it valid in India?+
A foreign divorce decree is recognised in India only if both parties were domiciled in that foreign country at the time, or the Indian spouse submitted to that court's jurisdiction. A divorce obtained unilaterally by one party serving notice on an unwilling Indian spouse is generally not recognised in India.
What is the Domestic Violence Act and who can apply?+
The Protection of Women from Domestic Violence Act 2005 protects women who have lived in a shared household with the respondent and have been subjected to domestic violence (physical, sexual, emotional, verbal or economic abuse). Remedies include protection orders, residence orders and monetary relief.
