Are non-compete clauses enforceable in India?+
Post-termination non-compete clauses are generally unenforceable in India under Section 27 of the Indian Contract Act, which voids agreements in restraint of trade. However, non-solicitation of clients and employees, and confidentiality obligations, can be enforced. During employment, reasonable restrictions are enforceable.
Is POSH Act applicable to startups and small companies?+
Yes. The POSH Act applies to all organisations with 10 or more employees, regardless of industry or company size. Organisations with fewer than 10 employees need not constitute an ICC but must still provide a safe workplace and can approach the Local Complaints Committee for complaints.
What is the process for terminating an employee?+
For non-workmen employees, notice period per the employment contract must be served (or payment in lieu). For workmen under the Industrial Disputes Act in companies with 100+ workmen, prior government permission is required for retrenchment. All terminations should follow natural justice principles.
What are the key changes under India's new Labour Codes?+
India has consolidated 29 central labour laws into 4 Labour Codes: Code on Wages, Industrial Relations Code, Code on Social Security and Occupational Safety Code. Key changes include revised definitions, consolidated PF and ESI, increased floor wages and revised retrenchment provisions.
Can an employer monitor employee communications?+
Employers can monitor work-related communications on company systems with appropriate notice to employees through an IT/acceptable use policy. Covert monitoring without notice raises privacy concerns under the DPDP Act 2023. We advise on lawful employee monitoring frameworks.
