What documents should I verify before buying property in India?+
Essential documents to verify include: title deed (clear ownership chain), encumbrance certificate (no outstanding loans or charges), approved building plan and occupancy certificate, property tax paid receipts, Khata certificate (Karnataka), RERA registration (for under-construction properties), and NOC from housing society.
What is an encumbrance certificate and why is it important?+
An encumbrance certificate (EC) is an official record from the Sub-Registrar's office showing all registered transactions (mortgages, charges, sales) affecting the property. A clear EC indicates the property is free from encumbrances and is critical in every property purchase. We advise on the appropriate period for which an EC should be obtained.
What does RERA provide to home buyers?+
RERA protects home buyers by mandating developers register projects, maintain 70% of collections in an escrow account, disclose all project details online, adhere to completion timelines and maintain quality standards. Buyers can file complaints with the RERA authority for possession delays, defects or failure to deliver committed amenities.
Can an NRI purchase property in India?+
Yes. NRIs and PIOs can purchase residential and commercial immovable property in India under FEMA general permission — no prior RBI approval is required. They cannot purchase agricultural land, plantation land or a farmhouse. We advise on the complete NRI property transaction framework.
What is the process for partitioning jointly owned property?+
